2 Country MLC Sir Arthur Trethowan died on 26 November 1937. Country candidate Herbert Henley was elected to replace him on 17 December 1937.
3 UAP MLC Herbert Hawkins died on 16 June 1939. UAP candidate Keith Brooks was elected to replace him on 8 August 1939.
4 The seat of independent MLC Theodore Trautwein was declared vacant on 16 April 1940 following his conviction for making false representation. The vacancy carried over to the next parliament.
